Our team provides direct representation, consulting, and resources to defense teams representing individuals in these communities. By challenging discriminatory policing, prosecution, sentencing, and conditions of confinement, we seek to dismantle systems of heterosexism and anti-2SLGBTQ+ (Two-spirit, Lesbian, Gay, Bisexual, Trans, and Queer) bias embedded in the use of capital punishment.

Areas of Practice
Direct Representation
We represent women and 2SLGBTQ people facing the death penalty as counsel, learned counsel, mitigation specialists, investigators, and paralegals. We provide this representation in jurisdictions across the country and at every stage of proceeding. Upon identifying a case that requires our expertise and particular cultural competencies, please reach out to discuss our potential appointment.
Consultation and Expert Assistance
We provide consultation services for capital teams representing women or 2SLGBTQ clients in trial, state post-conviction, federal habeas, and clemency proceedings. Our consultation services are broad and include supervising and guiding gender- and queer-sensitive mitigation and fact investigations, assisting with motions practice, effectively identifying and interviewing culturally competent experts, developing gender-based claims, and providing expert support in litigating for more resources or time. We also assist teams with amicus briefs by identifying and organizing amici, developing brief strategy, and drafting amicus briefs. Additionally, we provide support with advocacy and movement building for teams navigating the later stages of proceedings, such as cert-stage litigation, warrant litigation, and clemency campaigns. Finally, certain team members serve as testifying experts in post-conviction proceedings concerning the standard of care of effective assistance of counsel and the mitigation function in representing women and 2SLGBTQ people.

We host a repository of scholarship, pleadings, and guides to representing women and 2SLGBTQ people, including guides on assembling a culturally competent team, conducting effective voir dire, drafting motions in limine to bar biased prosecutorial narratives, identifying and interviewing culturally competent experts, and challenging conditions of confinement.
